Welcome to the Phone Cash (Gadgetwood E-Services Private Limited's ("Yaantra")))

By accessing, browsing or using our Website, the Customer/Seller agrees to comply with and be bound by the following Terms & Conditions (the “T&C”) and all terms and conditions incorporated by reference. Please review these T&C carefully before using the Website and information provided by Yaantra, its subsidiaries and affiliates. It is requested that the Customer/Seller read them carefully.
Yaantra owns, operates and runs the Site and mobile applications on Google Play store and Apple App store. The Website and mobile applications, and/or any website(s) we may have in the future that refer to these T&C, will provide a marketplace and platform for Refurbish Mobile Phones, with third-parties which include, but are not limited to, other companies, contractors and sub-contractors, and any other entities which may be affiliated to Yaantra for the purpose of the Services (collectively, "Third Parties"). The Yaantra platforms, which have a marketplace and other related functionality, whether provided through the Website or through any other media, will be collectively referred to as the "Services" in the T&C.
The Customer/Seller may not avail the use of the Website or the Services if they do not agree with any part of these T&C. Yaantra may, without notice to the Customer/Seller, at any time amend these T&C and any other information contained on this Website. The latest T&C will be posted on our Websites, and the Customer/Seller should review the T&C prior to using the Website. The Customer's/Seller's continued use of the websites after any changes to these T&C are posted will be considered acceptance of those changes.
Permitted Use and Compliance with Laws.
Yaantra hereby authorizes the Customer/Seller to access, view and use the Website content and software (collectively, the "Yaantra Property") solely to the extent necessary for the Customer/Seller to use the Services. The Website may not be copied, reproduced, modified, adapted, translated, transmitted, displayed, published, posted, resold, or otherwise distributed in any way, without Yaantra’s express prior written authorization. The Customer's/Seller's are granted permission to display on their computer, print and download the content on this Website solely for their own personal, non-commercial and educational use. The Customer's/Seller's must retain copyright and other notices on any copies of the content they make. The unauthorized use of the Yaantra Website or the content available on the Yaantra Websites or any linked websites may violate applicable intellectual property laws or other laws.

1. Yaantra Services and Third Party Services and Sites
The Yaantra Website may contain links and references to third party websites and resources (“Linked Websites”) which are provided for convenience and information purposes only. If the Customer/Seller decides to leave the Yaantra Website and access Linked Websites, the Customer/Seller does so at your own risk and Yaantra will have no liability arising out of or related to such Linked Websites and/or their content or any damages or loss caused or alleged to be caused by or in connection of any purchase or use of any such content, goods or services available on or through any such Linked Website. Yaantra has not reviewed the Linked Websites and will are not responsible for the content, accuracy or opinions expressed on these websites. Inclusion of these links on the Website does not imply approval or endorsement by Yaantra of the Linked Websites, their entities or products and services. The Linked Websites, even if they contain Yaantra logo or any other identification, are independent websites, and Yaantra does not control the content on the Linked Websites. Additionally, Yaantra is not a party to or responsible for any transaction the Customer/Seller may enter into with any such third party, even if the Customer/Seller learns of such third party from Yaantra, by way of reference or link provided on the Yaantra Website.
2. Privacy and Passwords
Yaantra values and protects the privacy of your information. Please review the Yaantra Privacy Policy, as it contains important information relating to your use of the Website and Services. Some portions of the Website are protected and require a user identification code ("User ID") and password for access. Unauthorized access or use of such portions of the Website is prohibited. You agree that you will notify Yaantra immediately if you believe that a third party has obtained your User ID or password, or if you believe that any unauthorized access or use may occur or has occurred. For your protection, if Yaantra believes that any unauthorized access may occur or has occurred, Yaantra may terminate access without prior notice to you. You also agree that Yaantra is permitted to act upon any instructions received such instructions as authorized by you.
3. Warranty Exclusions and Limitations of Liability
The Customer's/Seller’s use of and access to the Yaantra Website, and other online mediums and content posted by Yaantra, its divisions, subsidiaries or user generated content posted by third parties is at the Customer's/Seller’s sole risk. The Websites, online mediums and content are provided for informational purposes only on an “AS IS” and “AS AVAILABLE” basis without any express or implied warranty of any kind, including warranties of merchantability, non-infringement, or fitness for any particular purpose. Yaantra makes no representations, warranties or guarantees as to the quality, suitability, truth, accuracy or completeness of the content. Yaantra further makes no representations, warranties or guarantees that the quality and reliability of any information, and hosting services obtained from the Website, online mediums and/or content will meet the Customer's/Seller’s expectations and requirements, be virus-free, or perform error- and damage-free. The Customer/Seller assumes all risk and responsibility for any loss or damage whatsoever to their computer system, data and business arising out of their use of the Website, online mediums and/or content.
4. Indemnity
The Customer/Seller agrees to indemnify and hold Yaantra, its subsidiaries, affiliates, shareholders, officers, directors, agents, employees and representative harmless from any claims and demands, including reasonable attorneys’ fees, made by any third party arising from or relating to: (i) the Customer's/Seller’s use of and access to the Websites, online mediums and content; (ii) content a Customer/Seller may submit, post, transmit or otherwise make available via the Website and online mediums; (iii) a Customer's/Seller’s violation of these T&C. This indemnification obligation will survive the termination of the Customer's/Seller’s Yaantra account or affiliation in any other manner or these T&C.
5. Applicable Law, Jurisdiction, Compliance.
The Customer/Seller and Yaantra agree that all matters arising from or relating to the use and operation of the Website and/or the Services will be governed by the substantive laws of Republic of India, without regard to its conflicts of laws principles. The Customer/Seller agrees that all claims the Customer/Seller may have arising from or relating to the operation, use or other exploitation of the Website and/or the Services will be heard and resolved in the courts located in New Delhi.
6. No Waiver of Rights
Any delay or omission by Yaantra in the exercise any of its rights which may occur due to a default or non-compliance by the Customer/Seller in relation to the T&C will not be a waiver of such rights in any manner.
7. Entire Agreement
The T&C set forth the entire agreement between the Customer/Seller and Yaantra regarding the subject matter it covers, and supersedes all prior promises, agreements or representations, whether written or oral, regarding such subject matter. The Customer/Seller agrees that an electronic text containing such T&C constitutes their assent to the T&C hereof and would be held to constitute their assent to the same for all purposes.
8. Severability
In the event of any portion of any clause or any part of these T&C is, at a later date, found to be unenforceable or is struck down by a court of law of competent jurisdiction, then the other parts of the T&C or other part of such clause which has not been held to be invalid will continue to remain in force. The T&C would further continue to be wholly enforceable in any other jurisdiction other than the jurisdiction where such clauses or part of T&C may be rendered invalid or be struck down.
9. Information Collection, Use, and Sharing
By submitting any Yaantra contact form, the Customer/Seller understands that he/she may be contacted by a Yaantra representative or a representative from the partner they've chosen. The Customer/Seller may be contacted via telephone, email, text, or pre-recorded message regarding Yaantra programs, offers, events, announcements, and offers from Yaantra's third party marketing partners. If the Customer/Seller responds to any such offer, the Customer's/Seller’s information will be subject to that third party's terms and conditions.

The Customer/Seller also agrees that Yaantra may attempt to contact him/her via any telephone number he/she provide, even if it is a mobile telephone number which may result in charges to him/her.

The Customer/Seller understands that agreeing to the run diagnostics on Yaantra app program will allow Yaantra access to their device, solely in relation to conducting the assessment of the quality parameters of their device. In some cases Yaantra may use the information for its internal quality improvement purpose.
10. Yaantra Phonecash does not buy international phones.

Terms of use:
If we find an EMI LOCKED device or any device with unpaid dues, Yaantra claims all authority to return the device to the Customer/Seller and the Customer/Seller would be liable to pay the company exact amount paid for the device. In case of any disagreement, the company has all the right to take legal action against the Customer/Seller.

All introductory price quotations will be pending until our assessment or inspection of your mobile. The underlying offer is subjected to affirm upon the review of your mobile. We reserve the right to refuse or to purchase, any item that you sell. We reserve the right to change provided quote at any time.

The customer/seller is agreed that in case customer’s/seller's property found as stolen property in future, the customer/seller will be whole responsible and will bear all the expenses incurred by the company for litigation.

If we find an unexpected model in comparison to initially referenced, a model with any missing parts or in an unexpected condition in comparison to referenced, Yaantra claims all authority to change it's offer.

If the invoice of the device shared by the Customer/Seller is not the taxed invoice (issued at the time of purchase), Yaantra PhoneCash will automatically consider it in 10+ months age category.

If the Re-diagnosis process cannot be completed due to any circumstances, we reserve the right to refuse or to purchase, any item that you sell.

The company does not charge any cost for pick & drop service and will not be held responsible in case if the Customer/Seller pays for the same.

The following terms of use have to be read carefully before using the Website. The Terms of Use govern the Customer's/Seller’s access to and use of the Website. The Website is available for the Customer's/Seller’s use only on the condition that the Customer/Seller agrees to the Terms of Use set forth below. Access of the Website in any manner by the Customer/Seller or any other user implies an acceptance to be bound by the Terms of Use set forth below

The Customer/Seller acknowledges that the following is a contract between Gadgetwood E-Services Private Limited ("Yaantra"), the Customer/Seller and any other third party buyers who perform specified services (“Buyers”) in relation to used consumer products (“Products”).. The Customer/Seller acknowledges that Yaantra is acting as an intermediary to allow the Customer's/Seller's compliant with their policies to facilitate the sale of Products. The Customer/Seller also acknowledges that they are in transaction with Buyers and that Yaantra is only acting as a platform to facilitate such transaction. The Customer's/Seller's further acknowledge that only the Buyers are liable to them in relation to any transaction that the Customer/Seller undertakes on any Yaantra platform and that Yaantra shall have no liabilities towards the Customer's/Seller's in any form or manner. The Customer/Seller further acknowledges and agrees to the following in relation to the transactions it may or shall undertake on the Website or any other Yaantra platform, directly or indirectly:
1. The Customer/Seller certifies that it is the legal owner of any Products that it sells or attempts to sell on the Website.
2. The Customer/Seller acknowledges that any quotes provided at any point of the transaction, in relation to the sale of the Products, are tentative and will be pending the evaluation of such Product(s) and be contingent on any further defects or change in conditions which may develop or be found upon further inspections and evaluations of the Product(s). Yaantra reserve the right to refuse to offer to purchase any Product that the Customer/Seller may offer to sell for any reason we might think fit, at our sole discretion. Yaantra further reserves the right to change its quote for the Product(s) at any time prior to the completion of a specific transaction.
3. The Customer/Seller acknowledges that in the event there is a misrepresentation with respect to the Product and that upon Yaantra’s inspection, such Product(s) is/are found to be different in any form or manner including, but not limited to, a different model, different condition, different usage, then Yaantra reserves its rights to change or rescind any such offer that may have been made for such Product(s).
4. The Customer/Seller acknowledges that in order to sell any Mobiles on the Website, the Customer/Seller must compulsorily attach the following documents, in the manner or form as may be requested:
a). self-attested ID-proof (government approved) of owner of Product;
b). self-attested indemnity bond provided by Yaantra, if required;
5. The Customer/Seller agrees and certifies that, in order to sell Products on the Website, it is mandatory to, and that it must, own the right, title and all legal interest in the Product. It further acknowledges that any sale and/or shipment of any Product is not in violation of any applicable laws, regulations or statute of any competent jurisdiction. The Customer/Seller further acknowledges that through the transaction with Yaantra with respect to the Product(s), the Customer/Seller shall not illegally transfer any intellectual property, trademark, software, license, copyright or go on to infringe any other legal right or restriction in any manner, and that the sale of the Product and the Product itself shall be free of any such restriction. The Customer/Seller agrees to indemnify and hold Yaantra, its affiliates, suppliers, licensors and partners, and the officers, directors, employees, agents and representatives of each of them harmless, including costs, liabilities and legal fees, from any claim or demand that may be made in relation to the sale of Products. by third parties which may arise due to any foresight attributable to a lapse on part of the Customer/Seller in relation to any illegality in the transaction, or through the Customer's/Seller’s violation of any of the other terms of the Terms of Use.
6. The Customer/Seller acknowledges that it shall be responsible for deleting all data and/or any information that may be stored on a Product sold before such Products are handed over in relation with the specific transaction The Customer/Seller further acknowledges that in the event of the data not being erased in its entirety, or partially, or is accessible in any form or manner, the loss of such data or a breach of privacy due to such access shall not be the responsibility of Yaantra and that any approach for return of the data or device shall not be accepted in any situation.
7. The Customer/Seller understands that any Products which may have been obtained from a state sponsored scheme or through an NGO funded distribution programs or any other social welfare programme, shall not be accepted on the Yaantra Website or platform.
8. Yaantra reserves the right to modify these Terms of Use at any time without giving the Customer/Seller any prior notice. Your use of the Website/mobile app, or any of our tools and services on any platform, following any such modification would be construed as the Customer's/Seller’s acceptance of such terms and that such Customer/Seller will be bound by the modified Terms of Use which would be effective immediately upon publication.
